These Terms of Service (“Terms”) govern your access to and use of the MarketingPro website, application, software, and related services (collectively, the “Service”).
By creating an account, connecting a social media account, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and able to enter into a legally binding agreement to use the Service. If you use the Service on behalf of a business or organization, you represent that you are authorized to bind that entity to these Terms.
2. Description of the Service
MarketingPro is a social media publishing and marketing workflow tool that may allow users to:
- create, schedule, manage, and publish content;
- connect social media accounts, including Facebook and Instagram;
- authorize MarketingPro to publish content on a user’s behalf;
- access analytics, media, drafts, campaign workflows, and related features.
Some features may depend on third-party platforms, permissions, APIs, or approvals outside our control.
3. Third-Party Platforms and Meta Integrations
MarketingPro may integrate with third-party services, including Meta platforms such as Facebook and Instagram. Your use of those integrations is also subject to the applicable third-party terms, platform rules, permissions, and policies.
You acknowledge and agree that:
- you are responsible for maintaining your own Facebook, Instagram, and other third-party accounts in good standing;
- features may change, be limited, or stop working if a third-party platform changes its policies, permissions, APIs, or access terms;
- we may suspend or disable a platform integration if reasonably necessary to comply with law, platform rules, security requirements, or partner obligations.
4. User Accounts
To use certain features, you may need to create an account and provide accurate, current, and complete information. You are responsible for:
- maintaining the confidentiality of your login credentials;
- all activity under your account;
- promptly notifying us of unauthorized access or suspected security incidents.
We may suspend or terminate accounts that contain false information, violate these Terms, or create risk for the Service or other users.
5. Social Account Authorization
If you connect a Facebook, Instagram, or other third-party account to MarketingPro, you authorize us to access and use the information, content, permissions, and actions you approve through the relevant authorization flow in order to provide the Service.
Depending on the permissions you grant, this may include the ability to:
- retrieve account information and profile metadata;
- access connected pages, business accounts, or media libraries;
- create, schedule, and publish posts or media on your behalf;
- read limited performance or operational data needed to support the Service.
You represent that you have all rights and authority necessary to grant these permissions and to instruct MarketingPro to publish content on behalf of the relevant account or business.
6. User Content
“User Content” means any text, images, videos, captions, hashtags, comments, links, logos, account data, campaign materials, or other content you upload, submit, connect, schedule, or publish through the Service.
You retain ownership of your User Content. However, you grant MarketingPro a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, modify as technically necessary, transmit, display, and use your User Content solely to operate, improve, secure, and provide the Service.
You represent and warrant that:
- you own or control all rights necessary for your User Content;
- your User Content does not infringe, misappropriate, or violate any third-party rights;
- your User Content complies with applicable law and platform policies;
- you have all required consents, releases, permissions, and licenses for the content you publish.
7. Your Responsibilities
You agree that you will not use the Service to:
- violate any law, regulation, court order, or contractual obligation;
- post unlawful, fraudulent, deceptive, defamatory, infringing, harassing, hateful, or abusive content;
- impersonate another person or misrepresent affiliation, sponsorship, or endorsement;
- publish spam, malware, malicious code, or harmful links;
- interfere with, disrupt, or attempt to gain unauthorized access to the Service, third-party platforms, or other users’ accounts;
- scrape, reverse engineer, or exploit the Service except as expressly allowed by law;
- use the Service in a manner that violates Facebook, Instagram, or other third-party platform requirements.
You are solely responsible for the content you publish, the timing of publication, and the destinations you select.
8. Compliance With Platform Rules
Because MarketingPro interacts with external social networks, you agree to comply with all applicable third-party rules for any connected platform.
You understand that:
- some publishing features may only be available for supported account types or approved app configurations;
- platform providers may reject, remove, throttle, restrict, or flag content;
- approval of an app or permission by a platform does not create any warranty by MarketingPro.
9. Fees and Billing
If MarketingPro offers paid subscriptions or paid features:
- fees, billing periods, and included features will be described at the point of purchase;
- you authorize us and our payment processors to charge the payment method on file for all applicable amounts;
- unless stated otherwise, subscriptions renew automatically until canceled;
- fees are non-refundable except as required by law or expressly stated by us in writing.
We may change fees or pricing plans on prospective notice.
10. Free Trials and Beta Features
We may offer free trials, pilot programs, or beta features. These may be modified, limited, or discontinued at any time.
11. Intellectual Property
The Service, including its software, branding, design, workflows, interfaces, templates, and underlying technology, is owned by MarketingPro or its licensors and is protected by intellectual property laws.
Except for the limited rights expressly granted in these Terms, no rights are granted to you. You may not copy, distribute, modify, sell, lease, sublicense, or create derivative works from the Service except as permitted by us in writing.
12. Feedback
If you provide suggestions, ideas, or feedback about the Service, you grant us a non-exclusive, perpetual, irrevocable, worldwide, royalty-free right to use and exploit that feedback for any lawful purpose without compensation to you.
13. Privacy
Your use of the Service is also subject to our Privacy Policy, which describes how we collect, use, and disclose information.
14. Service Availability
We work to keep MarketingPro reliable and available, but availability may occasionally be affected by maintenance, technical issues, third-party platform changes, or circumstances outside our control.
We may update, modify, suspend, or discontinue any part of the Service at any time.
15. No Responsibility for Claims
MarketingPro is not responsible for any claims, demands, losses, damages, actions, proceedings, liabilities, costs, or expenses arising out of or related to:
- content created, uploaded, scheduled, or published by users;
- user activity on Facebook, Instagram, or other third-party platforms;
- account suspensions, content removals, policy enforcement, or other actions taken by third-party platforms;
- unauthorized use of a user account caused by the user’s failure to protect login credentials;
- any business, reputational, financial, advertising, or platform-related consequences resulting from the use of the Service.
Users are solely responsible for their content, actions, connected accounts, and compliance with applicable laws, regulations, and platform rules.
16. Termination and Suspension
You may stop using the Service at any time.
We may suspend or terminate your access immediately, with or without notice, if:
- you violate these Terms;
- you create risk or possible legal exposure for us, users, or partners;
- your use violates platform rules or third-party requirements;
- we are required to do so by law, court order, or a platform provider.
Upon termination, your right to use the Service ends immediately. We may delete or deactivate associated data in accordance with our retention practices and applicable law.
17. Changes to These Terms
We reserve the right to update, modify, or replace these Terms at any time, in our sole discretion, without notice and without requesting user approval. Updated Terms become effective when posted, unless otherwise stated.
Your continued use of the Service after the updated Terms are posted constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Service.
